INSURANCE

The conduct of insurance business in Malta is regulated by a number of legislative instruments. The Insurance Business Act, revamped in 1998 to ensure the proper regulation of insurance undertakings and to satisfy the criteria of the European Single Market Directives, is the main legislative instrument in force in Malta, consisting only of a skeletal regulatory framework supplemented by a number of legal notices as well as directives and regulations published by the competent authority - the Malta Financial Services Authority.

The European Passport Rights for Insurance Undertaking Regulations, which have come into force on the 1st of May 2004 in view of Malta’s accession to the European Union, allows Maltese undertakings to offer their services throughout the European Union, an equal right being conferred unto European undertakings based in EU or EAA Member states to offer their services or to establish a branch office in Malta. A second legislative instrument in the field of insurance is the Insurance Brokers and Other Intermediaries Act which regulates the business of insurance broking and other insurance intermediaries. Whilst authorisation and supervision of insurance undertakings is the competence of the Insurance Unit within the Malta Financial Services Authority, enforcement of regulatory breaches is entrusted to the Malta Financial Service Tribunal.
